Behold, mortals. I am Tire God, and I decree these Terms govern your journey upon this website (the “Site”) and any store, account, or service we provide (collectively, the “Services”). By accessing or using the Services, you accept these edicts.
Use the Services only for lawful purposes and in accordance with these Terms. You represent that you are at least the age of majority in your jurisdiction (or have the consent of a parent/guardian) and that you have authority to enter into this covenant.
You are responsible for safeguarding account credentials and restricting access to your device(s). Notify us immediately of any unauthorized use or suspected breach. We may suspend or terminate accounts to protect the realm.
By placing an order, you warrant that (a) information you provide is accurate and complete, (b) you have legal authority to use the payment method, and (c) you agree to prices, taxes, shipping, and any additional terms shown at checkout. All monetary exchanges follow the methods and rules revealed during checkout; your proof of purchase stands as your covenant with Tire God.
Taxes & Duties. You are responsible for any applicable taxes, duties, and fees.
Refunds/Returns. Where offered, refunds or returns are governed by our posted policy at purchase; some items may be final sale as permitted by law.
Fraud Review. Orders may be declined, limited, or canceled to prevent fraud or abuse.
We grant you a limited, non‑exclusive, non‑transferable license to access and make personal, non‑commercial use of the Site. No mortal shall exploit, mirror, scrape, frame, reverse engineer, or tamper with the code or functionality. We reserve power to limit or restrict access without notice to uphold this sacred trust.
All content on the Services—including text, graphics, logos, icons, images, videos, product formulations/descriptions, and software—is owned by Tire God or its licensors and is protected by law. Except as expressly allowed, you may not copy, distribute, modify, create derivative works, or publicly display any content without written permission.
If you submit reviews, images, messages, or other materials (“User Content”), you grant Tire God a worldwide, royalty‑free, perpetual, irrevocable license to use, reproduce, modify, publish, translate, create derivative works from, distribute, and display such User Content in any media for operating and improving the Services and for marketing, subject to our Privacy Policy. You represent that you own or have rights to your User Content and that it does not infringe, violate, or misappropriate any rights or laws.
You shall not: (a) use the Services for unlawful, harmful, or deceptive purposes; (b) impersonate any person or entity; (c) attempt to gain unauthorized access to systems or data; (d) upload malware or interfere with security features; (e) engage in automated data extraction without prior written consent; (f) violate any applicable export, consumer protection, or advertising laws.
The Services may link to third‑party websites or integrate third‑party tools. Such realms are not under our control; we are not responsible for their content, policies, or practices. Your dealings with third parties are solely between you and those entities.
We strive to keep product information accurate and current, but errors may occur. Except as expressly stated in our written warranty accompanying a product, the Services do not provide guarantees, professional advice, or emergency roadside assistance. Always follow product instructions and applicable safety guidelines.
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, TIRE GOD AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON‑INFRINGEMENT, AND THOSE ARISING BY STATUTE OR FROM COURSE OF DEALING OR USAGE. We do not warrant that the Services will be uninterrupted, error‑free, secure, or free of harmful components.
Product Warranty. Some products may include a separate limited warranty (e.g., Tire God’s 2‑Year Limited Tire Protection Warranty up to $2,500 per vehicle when properly installed). That warranty, if provided with the product, governs; nothing herein expands it.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIRE GOD AND ITS OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE TRANSACTION GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT, OR $100 IF NO SUCH PURCHASE WAS MADE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; THESE TERMS APPLY TO THE FULLEST EXTENT ALLOWED.
You agree to defend, indemnify, and hold harmless Tire God and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your: (a) use of the Services or products; (b) violation of these Terms; (c) User Content; or (d) violation of any law or rights of a third party.
These Terms are governed by the laws of the state and country where Tire God is organized and maintains principal operations, without regard to conflict‑of‑law provisions, and except where local law requires otherwise. Subject to the Arbitration clause below, exclusive venue for disputes shall be the courts located in that jurisdiction.
Before bringing a claim, the parties shall first attempt good‑faith negotiation for 30 days after written notice. If unresolved, binding arbitration administered by a recognized provider (e.g., AAA or JAMS) will be held in the county of our principal place of business, in English, before a single arbitrator. YOU AND TIRE GOD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Injunctive relief in court for IP or security misuse may be sought where permitted.
Consumers in the EEA/UK may have mandatory local rights that supersede this clause; nothing herein limits non‑waivable consumer rights.
We may suspend or terminate access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, sections that by their nature should survive (e.g., IP, warranties, liability, arbitration) shall endure.
We may revise these Terms at any time. Changes are effective when posted to the Site with a new Effective Date. Continued use after changes constitutes acceptance. If you do not agree, discontinue use of the Services.
Entire Agreement. These Terms, together with any policies referenced herein (e.g., Privacy Policy) and any product‑specific terms, form the entire agreement between you and Tire God.
Severability. If any provision is held invalid, the remaining provisions remain in force.
No Waiver. Failure to enforce a provision is not a waiver.
Assignment. You may not assign rights or obligations without our consent; we may assign as part of a reorganization or sale.
